Heirs who block
When someone will not sign, answer or advance the partition: procedural pressure and strategy to unblock.
If you arrived seeking help with a succession, this is what is usually at stake, and how we approach it.
A partner with a doctorate in Law signs the file, not a passing associate.
Office at Antonio Acuña 9. Members of the Madrid Bar (ICAM).
Routes, timelines and real risks from the first contact.
Also when there is a family dispute or tax issues tied to the division.
We do not process routine estates in a chain. We step in when the file hurts or the division does not move.
When someone will not sign, answer or advance the partition: procedural pressure and strategy to unblock.
Challenge, construction of the will and defence of forced shares when the division harms a forced heir.
Shared property after the estate that no one wants, or everyone wants. Court or negotiated exit with asset judgment.
Assets in more than one country, heirs abroad and languages: the same partner keeps the thread.

In inheritance and asset litigation, the case is led by who will go to court.

Called to the Bar since 1986. Civil, procedure and inheritance. Experience when the file crosses borders: maritime, insurance and international assets.
No theatre. Three steps to know if we can help.
Tell us the blockage: will, heirs, property, deadlines. We filter urgency and fit.
We review key papers and set out routes: negotiation, court partition, interim measures.
If you go ahead, the same partner keeps the thread to closing or judgment.
Direct answers for those looking for an inheritance lawyer in Madrid.
A will organises the deceased’s wishes but does not close the file alone. Heirs still need to accept or renounce, inventory assets and debts, settle tax and notarize the division when there is property.
A lawyer is needed when heirs conflict, the will’s validity or meaning is disputed, forced shares are harmed, prior gifts must be collated, or assets are hard to liquidate.
Also if an heir will not sign or cannot be found: the notary cannot force consensus. Then the will is the starting point, not the solution, and court or directed negotiation is usually needed.
Do not wait forever for them to come around. Document the blockage and act before assets deteriorate or debts and taxes pile up.
Usual routes include court partition, appointment of a partitioner where available, and measures over assets at risk.
On the first call we review who blocks, on what ground and what assets are on the table.
Under Spanish common law, forced heirs generally have a reserved share. If the will, lifetime gifts or the division harm it, actions exist to protect or top up what was received.
It is not automatic: the estate, collatable gifts, disinheritance issues and time limits must be analysed.
In consultation we say clearly whether your case fits, what papers we need and what risk you take, without generic promises.
There is no single deadline. An agreed succession with a clear inventory can close in a few months. With litigation, time is driven by the court, evidence and valuations.
A contested estate in Madrid is often measured from about a year to several, depending on complexity.
On the first consultation we give a realistic frame for your file, not a magic number.
It depends on conflict versus paperwork, heirs, properties, litigation or cross-border assets.
We do not quote generic fees without knowing the case. On the first conversation we explain fit, phase and fee model.
We also flag associated costs that are not lawyer fees.
Yes. Heirs abroad, property outside Spain or international links are common.
We coordinate from Madrid in Spanish, English and Romanian when needed.
On the first call we identify what is resolved here and what must be articulated abroad, always with a partner keeping direction.
First response from a partner. Not a chain of associates.
