The house is not split in the abstract: net value, debt and bank risk matter.

Dividing marital property after divorce gets harder when the main asset is a mortgaged home. Keeping the house is not enough: you must fix who pays the loan, how the other spouse is compensated, and whether the bank releases liability. Madrid settlements often award the property but forget joint debt. This analysis orders the steps and mistakes that make closure expensive.

What goes into the marital pool

Under community of property, acquisitions during marriage are usually shared, with specific exclusions.

The mortgage does not vanish when a court awards the home: the loan remains tied to the contract and often both borrowers.

Market or appraisal value minus outstanding debt must be calculated. Splitting “the flat” without deducting the loan creates false compensation.

Accounts, savings and other debts also count. The home is the focus, not the only figure.

Award and compensation

If one spouse keeps the home, they usually compensate the other with half the net value, subject to prior payments.

Compensation may be cash, staged or via other assets. It must be enforceable and dated.

Without liquidity, agree future sale, split of proceeds or temporary rent. Open-ended “when prices rise” clauses breed litigation.

Children in the home may justify temporary use separate from final ownership.

The bank does not follow your settlement automatically

Releasing the non-occupying borrower requires bank negotiation: novation, subrogation or sale with cancellation.

Until release, the exiting spouse may remain exposed if the keeper defaults.

Missed payments hit both if liability was never changed at the bank.

Sometimes coordinated sale is the only clean exit: cancel the loan and split the surplus.

Tax and land registry

Awards may trigger transfer tax depending on region and base.

Registry updates and partial cancellations need documents aligned with judgment or division deed.

Charges, arrears or embargoes must be ordered in the settlement.

Lawyer, conveyancing and tax advice should run in parallel.

Documents we ask for upfront

Land registry note, deed, amortisation schedule and mortgage balance certificate.

Recent valuation or agreed method.

Joint account statements and non-mortgage debts.

We then model award, sale or temporary use with numbers on the table.
